We know such terms can be confusing. This is why we are here to help you understand the difference between Abu Dhabi Notary Public Services and Contracts & Agreements Services in UAE. Take a look.

NOTARIZATION

Notarization is the act of officially certifying a legal document by a public notary. The purpose of having a legal document notarized is to ensure the authenticity of the signatures that appear on the document.  The notarization process is designed to avoid frauds in sensitive and important matters, such as issuing power of attorney, buying and selling of property, giving consent for a minor to travel without one or both parents, etc. The notarization makes a document legalized for further proceedings in attestation and legalizations. It is the basic procedure of Authentication which is done before any other Attestation procedures in which the document bears a Notary Stamp of a Notary Public Offices. It gives the document authenticated for all the attestations including the Home department or Human Resource Department (HRD), Ministry of External Affairs (MEA) and Embassy legalizations.

TRUE COPY ATTESTATIONS ( Certification of True Copy of Documents) / ATTESTATION

Attestation is the method of checking the authenticity of a document & declaring its authenticity by attaching it with the sign of the verifying personnel. The process requires the submission of original documents as well as a xerox of the same to authorized employees for verifying and required sign/stamp on the guided area.

Attestations are most commonly associated with agreements of great personal and financial significance, especially legal documents involving wills or powers of attorney. Attestations are also used when a witness is filing a police report. The witness signs to confirm that their statement is valid, and another person signs as an attestation that the first signature was authentic.

Attestation differs from notarization, which requires a state-commissioned notary public to not only sign but add their stamp to the document.

SIGNATURE VERIFICATION

Signature verification is a process in which the Elements of a signature will be studied by the institution and the notary public who needs the specimen .Specimen signatures are vital to any institution, agency, as well as for government organizations. The notary signature verification form will be used by a notary public to validate a user’s signature and to assure that there are no acts of forgery in a document. Signs of forged entries include the intended pen-lifts, the width of the signature, as well as the depth which was caused by the pen when affixing an individual’s signature.

AFFIDAVITS

An affidavit is a type of document that contains a verified statement and it’s often used as evidence in UAE courts. An affidavit can be in the form of a written statement as to witness in court a certain information. This is a written statement used as evidence in court to prove to the judge about a certain information. A legally binding document, it should be notarized and legalized by a notary public to make it valid in court. The document may also act as an information to provide help in judging and coming up to a decision. A number of considerations have to be taken into account with affidavit drafting.
Our legal drafting team also drafts different types of affidavits such as:

  • Self-proving affidavits
  • Affidavit of loss of passport
  • Affidavit of support
  • Joint affidavit of witness to a marriage
  • Affidavit letter of litigation

APOSTILLE ATTESTATION

An Apostille is a kind of attestation in which certificates are legalized in an appropriate form that is admissible in all countries that relate to the Hague Convention. Apostille is a global attestation that is admissible in nearly 92 nations, and most of the western world acknowledges Apostille. Apostille is done for personal documents like Birth, Marriage, Death Certificates, Affidavits, Educational documents like Degrees, Diplomas, Secondary level Certificates etc.

Apostille stamp is a computer-generated sticker stamp in a square-shaped, fixed on the backside of the certificate. It has a different ID number, by which any associate nation of The Hague convention can verify its legitimacy online. Under normal circumstances, once the document has been Apostilled by MEA, it does not need to be attested any more from the concerned foreign embassy.
